Our web site is accessible worldwide to anyone with Internet access. Its operations are carried out by Peakmedia Group. All the payments are processed by Peakmedia Group. Access to and use of our site are subject to these terms and conditions.

2. Online Services Agreement

This Agreement is made by and between PeakMedia Group LTD,  hereinafter referred to as the “Company.
This Agreement applies to both the Site and trading platform, and to the electronic content and / or software currently contained on the Site that provides the customers with real-time information on exchange rates of currencies, and the program transaction services on the forex market via internet, telephone or fax, and any other features, content or services that AskOption may add later (the “Services”).

3. Subject of the agreement

Subject of this Contract is to provide Services by Company to Client.
The Company’s Services includes the procuring of the access of Client to the Site and information platform located on the Site, support of Client by Company in relation to Services, procuring of analytics and news information.
3Proceeding a payment on the Site, client makes a deposit in his account.
Hereby Client agrees that:
— Company does not provide Client with any trust services for Client’s funds;
— Company does not provide Client with trading and any other recommendations in relation to the Operations performed by Client;
— Company reserves the right to transfer the Client’s orders to conduct Operations even if such Operation is or may be unprofitable for Client;
— Company is not liable for the results of the Clients’ Operations.
Hereby Client warrants that:
— all provisions of this Contract were carefully read and accepted by the Client as terms that will define all conditions of Client-Company interaction;
— Client is the only authorized user of the Company’s Services and Client is irreplaceable subject of legal relations emerging from performance of this Contract by Client and Company;
— Client’s rights cannot be delegated, and obligations cannot be imposed on any other person;
— no person excluding Client has rights of action or obligations regarding Operations conducted by Client on the Site;
— Client is not subject to any law or regulation which prevents his enter or performance of this Contract or any Operation;
— the information provided by Client to Company is complete, true, accurate and not misleading in any respect.

4. Membership Eligibility

Services are available and reserved only for individuals or businesses that can establish a legally binding contract under the laws applicable in their country of residence. Without limiting the undermentioned terms, our Services are not available to people aged under 18 or who have not attained the legal age (“Minors”). If you are a minor, you cannot use this service. PLEASE DO NOT USE THIS SITE IF YOU ARE NOT QUALIFIED.

To avoid any doubt, we disclaim any liability for unauthorized use by minors of our Services in any manner or another. 5. Registration Information and Requirements

During your registration you’ll have to provide certain identifying information. You are responsible for the security of your account’s login and password with AskOption. You are solely responsible for any damage caused by reason of any act or omission resulting in improper or illegal use of your account.

You agree to provide accurate and complete information about yourself during the registration process and you also agree not to impersonate another person or entity, and not to hide your identity for AskOption for any reason whatsoever. If you register as a commercial entity, you declare that you have the required authority to bind that entity to this Agreement.
AskOption treats carefully the information you provide to us according to the disclosure of information provided during the registration process and privacy policy.

5.1 Depositing or Withdrawing Requirements

Certain requirements must be met when depositing or withdrawing with ASKoption.

Every client is required to submit the following documents that authenticate their account with ASKoption:

  • A Photo ID: a government issued document, which can be a driver’s license, passport or a residency card.
  • A provision of proof of your physical or billing address, such as a bank statement or a utility bill in the country of your residency, which is not older than 3 months.
  • When depositing via credit/debit card, a copy of the card used to make the deposit must be submitted. The copy must be made from the front and back. The first 12 digits and the CVV on the back must be covered, whilst the signature panel with your signature must be clearly visible.

The above documents must be clearly visible and in color. They must be sent by e-mail to[email protected] with your name as the subject of the e-mail.

6. Legal Restrictions

Without limiting the undermentioned provisions, you understand that laws regarding financial contracts vary throughout the world, and it is your responsibility to make sure you properly comply with any law, regulation or guideline in your country of residence regarding the use of the Site. You also agree not to use electronic communication feature of a Service on the Site for any illegal, abusive, intrusive, obscene, threatening or hateful purpose, as well as harassment and vilification in the privacy of others. The license granted hereunder shall terminate if AskOption considers that any information provided by you, including your e-mail is no longer current or accurate, or if you fail to comply with any term or condition of This Agreement and all rules and guidelines for each service. It will be the same if AskOption determines that you committed a crime on the AskOption trading platform (including without limitation the conclusion of a transaction outside the market rates).

If such a violation occurs, you agree to cease accessing the Services. You agree that AskOption, in its sole discretion and with or without notice, may terminate your access to all or part of the Services, close any open transaction and remove and discard any information or content within a Service.

8. Risk Disclosure

You use the Website and Services at your own risk and the company shall not be responsible for any damages or losses of any kind that you may incur as a result of modifications, enhancement, termination, suspension and/or discontinuation of the Website or any of the web site’s Services. The company shall not be responsible for any damages or losses you may suffer as a result of your use or reliance on the content of any website to which links appear on the Website. Any third-party links, services, resources and information that we provide on or make available through the Website are not controlled by us. 11. Trading Cancellation

AskOption reserves the right in its sole discretion, to refuse or cancel services, and/or refuse to distribute profits to any person for legitimate reasons, including, without limitation:

if AskOption has reason to believe that a person’s activities on the Site may be illegal;
if AskOption may be harmed by any fiscal or pecuniary damage due to anyone’s activities;
if AskOption considers that one or more operations on the Site were made in violation of this Agreement.

12. Withdrawal procedure

AskOption finance department supervises every withdrawal request submitted. Identification documents must be submitted for any withdrawal. There is no fee relating to withdrawal by credit card, but any withdrawal by wire transfer will be charged with the amount of $30.

According to generally acceptable AML rules and regulations, withdrawals must be performed only through the same bank account or credit/debit card that you used to deposit the funds.
Client may be required to present additional information and documents.

When a withdrawal request is submitted, AskOption may take up to 15 business days to process the request, following the receipt of the verifying documents. When your payment is approved please wait 3 to 7 additional days before your funds will be included to your account.

13. Return and refund policy

In order to make a withdrawal Client has to make an enquiry from Client’s “personal zone” on the Site. In order to complete the enquiry Client has to choose any of the withdrawal methods from the list and fill all the necessary details.
After a withdraw request is made, it receives a “Requested” status. After the request comes to process, it receives a “In process” status. After receiving “In process” status, funds are removed from balance. Funds will be transferred to the payment system wallet after a request receives a “Processed” status.
Withdrawal enquires processed by the financial department of Company one by one. The time of the process may vary from one (1) business day up to five (5) business days. Company reserves the right to increase the processing time, in that case Company notifies Client by one of the contact methods which was provided by Client during the registration on the Site.
Withdrawal can be processed on the personal details, used to deposit only. In case if there is no technical possibility to withdraw funds to the payment system account used to deposit, a method will be chosen by Company, according to Client’s possibilities. In such case payment details should be similar to the Client personal details.
Client takes full responsibility for the information provided by Client at the enquiry of withdrawal.
If Client uses a bank card for input of money, withdrawal of funds shall be performed on this card on the amount which isn’t exceeding the input amount from this card for the period 90 (ninety) calendar days from the moment of input of money. Withdrawal of funds on a bank card is priority.
The Company undertakes to make a refund in 10 days after receiving a letter with request

14. Investment Benefits and Bonus Policy

AskOption offers a number of attractive reward features to its new and returning traders. Cash promotions, bonuses and one-time trading credits rewarded to customers are part of PFL’s promotions program. These bonuses are limited time offers and the terms and conditions associated with any bonus rewards are subject to change. Unless stated otherwise on specific promotions the default promotional terms apply to all bonuses as shown below:

Withdrawal of funds which have received additional rewards, bonuses, or promotions, require a trading volume fulfillment of 30 times the bonus or in the event of a refund bonus 20 times the bonus amount. The trade volume requirement begins upon receipt of the bonus in the traders account. Upon receipt of the bonus, the trading requirement must be fulfilled prior to withdrawing funds from the account. The volume requirement is subject to cancellation should the account balance drop below the minimum amount required to place one (1) trade. The minimum trade is 5 EUR/USD/GBP/AUD depending on the currency of your account. Canceled trades are not counted towards the trading volume.

All funds can only be withdrawn when the preceding stipulation has been fully met and fulfilled; this includes the original deposit and all other subsequent deposits. Please note the amount for the requested withdrawal is only deducted from your account balance once the funds have been transferred.

Any indication of fraud, manipulation, cash-back arbitrage, or other forms of deceitful or fraudulent activity based on the provision of the bonus may nullify the account and any/all profits or losses garnered.

We decline responsibility for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, hardware or software, or any technical failure because of technical problems or traffic congestion on the Internet, the Site or any Service.

LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION AND IN NO EVENT SHALL THE AskOption LIMITED CUMULATIVE LIABILITY TO YOU EXCEED THE AMOUNT OF MONEY YOU TRANSFERRED OR DEPOSITED IN YOUR ACCOUNT ON THE SITE IN CONNECTION WITH THE TRANSACTION GIVING RISE TO SUCH LIABILITY.

16. AML Procedures

Online traders should provide all information required for registration.
The earnings will be paid to the person who first registered for an account online.
When a customer maintains an account through wire transfers, the gains will be distributed to the sole owner of the originating bank account. When you make deposits this way, it is the responsibility of the live trader to ensure that the trader’s account number and the registered name of the account owner accompany every transfer to AskOption.
When a fund is made using a credit card or debit card, the winnings will be distributed solely to the person whose name appears on the card used to make the deposit and will not be reimbursed on the same card.
Only one account is allowed per house-hold. No gains can be levied on accounts opened under false names or multiple accounts opened by the same person.
AskOption may, from time to time at its sole discretion, require from a customer to provide additional proof of identity such as notarized copy of passport or other means of identity verification as deemed necessary circumstances and may, at its sole discretion, suspend an account until the required proof is provided.

AskOption does not tolerate money laundering and supports the fight against money launderers.
AskOption follows the guidelines set by the UK’s Joint Money Laundering Steering Group. The UK is a full member of the Financial Action Task Force (FATF), the intergovernmental body whose purpose is to combat money laundering and terrorist financing.
AskOption now has policies in place to deter people from laundering money. These policies include:
• ensuring clients have valid proof of identification
• maintaining records of identification information
• determining that clients are not known or suspected terrorists by checking their names against lists of known or suspected terrorists
• informing clients that the information they provide may be used to verify their identity
• closely following clients’ money transactions
• Not accepting cash, money orders, third party transactions, exchange houses transfers or Western Union transfers.
Money laundering occurs when funds from an illegal/criminal activity are moved through the financial system in such a way as to make it appear that the funds have come from legitimate sources.

International Anti-Money Laundering requires financial services institutions to be aware of potential money laundering abuses that could occur in a customer account and implement a compliance program to deter, detect and report potential suspicious activity.

17. Intellectual Property

Every content, trademark, service mark, trade name, logo and icon are the property of AskOption or its affiliates or agents and are protected by law and international treaties and provisions relating to copyright. You agree not to remove copyright notices or other indications of protected intellectual property rights of any material you print or download from the Site. You will not obtain intellectual property rights, or any right or license to use such material or the Site, other than those set forth herein.

Images displayed on the Site are property of AskOption. You agree not to upload, post, distribute or reproduce any information, software or other material protected by copyright or other intellectual property right (including rights of publicity and privacy) without first obtaining permission from the copyright owner and the prior written consent of AskOption.

18. Indemnification

You agree to defend and indemnify Our company and its officers, directors, employees, and agents and to hold them harmless from and against any and all claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney’s fees and costs, arising out of / or in any way connected with your access to / or use of the Site or Services; your violation of any of the terms in this Agreement; or your breach of any applicable laws or regulations.

19. Term and Termination

The term of the Agreement shall be unlimited however Our company will be allowed to terminate this Agreement at any time by noticing you. As of termination, you shall not be able to carry out new transactions. You may terminate this Agreement at any time by giving the Company a 48 hours advanced notice. Termination of the Agreement by any of the Parties shall require you to close all open positions by executing the required Transactions. As of the date of the termination notice by you, you may not execute any new Transactions, which shall open new positions in your account.

20. General clause

Our company will not be liable in any way to any persons in the event of force majeure, or for the act of any government or legal authority.
In the event that any provision in this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
The failure of a party to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
Our company may assign this Agreement or any rights and/or obligations hereunder without your consent.
Our company may amend the terms of this Agreement from time to time by posting the amended terms on the Site. You are responsible for checking whether the Agreement was amended. Any amendment shall come into force as of the day it was published on the Site. If you do not agree to be bound by the changes to the terms and conditions of this Agreement, do not use or access our Services, and inform us in writing immediately.

21. KYC (Know Your Customer) Policy
